RE: The tariff classification of metal fasteners from Taiwan and an unknown country

Dear Mr. Walhood:

In your letter dated June 17, 2014, you requested a tariff classification ruling. The submitted samples will be returned to you.

The products under consideration are five metal fasteners to be used in coffee makers. You indicate in your letter that the proposed countries of origin may be subject to change.

The first item, identified as component number 50, “Tapping Insert,” SKU# 95631A050, is sourced from an unidentified country. It is a brass insert with internal and external threading that serves to fasten the arm trim on the coffee maker.

The applicable subheading for component number 50, SKU# 95631A050 will be 7415.39.0000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for nails, tacks, drawing pins…screws, bolts, nuts, screw hooks, rivets, cotters, cotter pins, washers (including spring washers) and similar articles, of copper: other threaded articles: other. The general rate of duty will be 3 percent ad valorem.

The second item, identified as component number 51, “Button Head Cap Screw- 5 mm long,” SKU# 92095A177, is made in Taiwan. This stainless steel screw has a button head with a hexagonal socket for tightening and measures 3 mm in diameter. It serves to fasten the light pipe in the coffee maker.

The third item, identified as component number 52, “Button Head Cap Screw-8 mm long,” SKU# 92095A181, is made in Taiwan. This stainless steel screw has a button head with a hexagonal socket for tightening and measures 3 mm in diameter. It serves to hold the PCB to the base of the coffee maker.

The applicable subheading for component numbers 51 and 52, SKU# 92095A177 and 92095A181, will be 7318.15.6010, HTSUS, which provides for screws, bolts, nuts, coach screws, screw hooks, rivets, cotters, cotter pins, washers (including spring washers) and similar articles, of iron or steel: threaded articles: other screws and bolts, whether or not with their nuts or washers: other: having shanks or threads with a diameter of less than 6 mm: socket screws: of stainless steel. The general rate of duty will be 6.2 percent ad valorem.

The fourth item, identified as component number 53, “SS Pan Head Screw- M4 X 16 mm,” SKU# 90116A215, is made in Taiwan. This is a pan head Philips screw made of stainless steel. It serves to connect the heating element to the base of the coffee maker.

The applicable subheading for component number 53, SKU# 90116A215, will be 7318.15.4000, HTSUS, which provides for screws, bolts, nuts, coach screws, screw hooks, rivets, cotters, cotter pins, washers (including spring washers) and similar articles, of iron or steel: threaded articles: other screws and bolts, whether or not with their nuts or washers: machine screws 9.5 mm or more in length and 3.2 mm or more in diameter (not including cap screws). The general rate of duty will be free.

The last item, identified as component number 54, “Flat Washer- 9 mm,” SKU# 91116A120, is made in Taiwan. It is a stainless steel washer that serves to hold the button onto the base of the coffee maker.

The applicable subheading for component number 54, SKU# 91116A120, will be 7318.22.0000, HTSUS, which provides for screws, bolts, nuts, coach screws, screw hooks, rivets, cotters, cotter pins, washers (including spring washers) and similar articles, of iron or steel: non-threaded articles: other washers. The general rate of duty will be free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
